What is the EB-2 Visa?

The EB-2 visa is an employment-based immigration category that allows for obtaining permanent residency (Green Card) in the United States. It is designed for professionals with advanced degrees or individuals with exceptional ability in sciences, arts, or business.

EB-2 Visa Requirements

There are two main routes to qualify:

EB-2 with a job offer to qualify (PERM required):

  • Advanced degree (master's or higher) or its equivalent (bachelor's degree + 5 years of progressive experience).
  • Job offer in the U.S. in a related position.
  • Labor certification process (PERM) to demonstrate that no qualified U.S. workers are available for the position.

EB-2 NIW (National Interest Waiver):

  • No job offer or PERM required.
  • Must demonstrate that your work is of great national importance to the U.S. (e.g., public health, innovation, national interest).
  • Direct application based on professional merit.

Who can apply?

  • Professionals with a master's or doctoral degree.
  • Individuals with a bachelor's degree and 5 years of progressive experience.
  • Individuals with exceptional ability in their field (even without advanced degrees).

Can I bring my family?

Yes. Your spouse and unmarried children under 21 years old can obtain permanent residency with you.

  • The spouse can apply for a work permit.
  • Children can study without restrictions.

EB-2 Visa Benefits

  • Direct path to the Green Card.
  • The NIW subcategory does not require a sponsor or job offer.
  • You can include your spouse and children under 21 years old.
  • Option to apply from the U.S. or from your home country.

Required Documents

  • Diplomas and academic degrees.
  • Work experience certificates.
  • Job offer (if applicable).
  • Evidence of national impact or relevance of the work (in NIW cases).
  • Letters of recommendation or publications.
  • Proof of memberships, awards, or significant contributions.

Frequently Asked Questions

Is a master's degree mandatory?

No. You can qualify with a bachelor’s degree and 5 years of progressive experience or with proven exceptional ability.

It is a waiver that allows you to apply without a sponsor if your work significantly benefits the U.S.

With NIW and premium processing, in some cases, it can be obtained in less than a year.

The EB-1 is for extraordinary achievements and is usually faster. The EB-2 is for advanced professionals or people with great potential, with or without a job offer.
