What is the H-1B Visa?

The H-1B visa allows U.S. companies to temporarily hire highly skilled foreign professionals in specialized occupations. This visa is ideal for engineers, programmers, scientists, accountants, architects, doctors, and other professionals who require university academic training.
It is one of the most popular visas for skilled workers who wish to establish employment in the U.S.

H-1B Visa Requirements

For the worker:

  • Must have at least a bachelor's degree or its equivalent in work experience (in some cases, a combination of experience + education is accepted).
  • Must have a formal job offer in the U.S.
  • The position must require specialized knowledge.

For the employer:

  • Must file a Labor Condition Application (LCA) with the Department of Labor.
  • Must pay the worker the prevailing wage for that position in their location.
  • Must file an H-1B petition with USCIS.

The visa is subject to an annual limit of 85,000 slots, so many applications participate in a lottery.

Who can apply?

  • University professionals in areas such as engineering, technology, mathematics, health, finance, architecture, etc.
  • Foreigners with work experience equivalent to a university degree.
  • Employers needing specialized foreign talent.
  • International graduates of U.S. universities who wish to stay legally.

Can I bring my family?

Yes. Your spouse and children under 21 can accompany you with an H-4 visa.

  • The spouse can apply for an Employment Authorization Document (EAD) if you are in the process of residency (I-140 approved).
  • Children can study without restrictions.

H-1B Visa Benefits

  • Allows you to work legally in the U.S. in specialized occupations.
  • Possibility of changing employers (with a new petition).
  • Allows you to subsequently apply for the employment-based Green Card (EB-2 or EB-3).
  • Spouse can obtain a work permit (in some cases).

  • Job offer and detailed job description.
  • Approved LCA certification.
  • Form I-129 and supplements.
