What is the O-1 Visa?

The O-1 visa allows individuals with extraordinary ability in the arts, sciences, education, business, film, television, or athletics to live and work temporarily in the United States. It is designed for individuals who have reached a level of national or international recognition in their field.

O-1 Visa Requirements

General requirements:

  • Demonstrate extraordinary ability through awards, recognitions, publications, press, or other verifiable achievements.
  • Have a job offer or contract with a company, institution, or agent in the U.S.
  • Prove that the stay will be temporary and directly related to your area of specialization.

At least 3 of the following criteria must be met:

  • Major awards (or nominations) in your industry.
  • Proof of leadership or participation in prestigious events.
  • Recognition in media, publications, or by experts in your area.
  • High salary compared to others in your industry.
  • Significant contributions in your field.

Processing Times

  • Case Preparation: 2 to 4 weeks.
  • I-129 Petition (USCIS): 2 to 6 months.
  • Premium Processing (optional): response in 15 business days.
  • Visa Duration: Up to 3 years, with possible extensions for 1 year depending on the project.

Who can apply?

  • Scientists, researchers, doctors.
  • Artists, musicians, actors, designers.
  • Athletes, coaches, high-level sports figures.
  • Executives or entrepreneurs recognized in their industry.

It is not necessary to be “famous,” but you must have concrete evidence of outstanding achievements.

Can I bring my family?

Yes. You can include your spouse and children under 21 years old under O-3 status.

  • They cannot work, but they can study during your stay.

O-1 Visa Benefits

  • Allows you to work legally in the U.S. in your field of specialization.
  • You can change employers (with a new petition).
  • You can include your essential support team (O-2).
  • Your spouse and children can accompany you (O-3).

Required Documents

  • Contract or job offer letter.
  • Evidence of achievements (awards, recognitions, publications, press).
  • Letters from experts or authorities in your industry.
  • Schedule or itinerary of the work to be performed in the U.S.
  • Form I-129 and supplements.

Frequently Asked Questions

Do I need an international award like an Oscar or a Nobel?

No. You can qualify with a combination of achievements, recognitions, publications, or leadership in your industry.

Yes. You can apply through an agent or company that represents your temporary contracts or projects in the U.S.

Yes. Many people with an O-1 visa later apply for an EB-1 or EB-2 NIW to obtain residency.

You must notify USCIS. If you wish to continue with another employer, you need a new O-1 application.
