USMCA Treaty

USMCA Treaty Professional

The TN visa is available exclusively to Mexican and Canadian citizens who will work in the United States in one of the professions listed under the USMCA (formerly NAFTA), with a much faster process than other work visas.

Requirements
✓ Be a Mexican or Canadian citizen
✓ Practice a profession included in the USMCA list (engineer, accountant, scientist, among others)
✓ Have a specific job offer from a U.S. employer
✓ Meet the academic or licensing requirements of the profession

✓ Fast process, with no lottery or annual quota
✓ Renewable indefinitely in increments of up to 3 years
✓ Your spouse and children can accompany you with a TD visa
✓ Considerably simpler cost and process than the H-1B

The EB-2 visa (including the National Interest Waiver) is a path to permanent residency for professionals with an advanced degree or exceptional ability whose work substantially benefits the United States, often without needing a job offer.

✓ Demonstrate exceptional ability in the sciences, arts, or business

The PERM process is the step required by the Department of Labor before many EB-2 and EB-3 petitions. The employer must show that no U.S. workers are available, qualified, and willing to fill the offered position.
