What is the EB-1 Visa?

The EB-1 visa is an immigration category that allows for obtaining permanent residency (Green Card) in the U.S. It is aimed at individuals with exceptional achievements in their professional field, including scientists, artists, professors, multinational executives, and other individuals with international recognition.

EB-1 Visa Requirements

There are three main subcategories within the EB-1:

EB-1A – Extraordinary Ability:

  • Evidence of extraordinary achievements in sciences, arts, education, business, or sports.
  • National or international recognition (awards, publications, leadership, etc.).
  • No job offer or sponsor required.

EB-1B – Outstanding Professors and Researchers:

  • At least 3 years of teaching or research experience.
  • International recognition in the academic field.
  • Permanent job offer in the U.S.

EB-1C – Multinational Executives or Managers:

  • Must have worked for a company outside the U.S. for at least 1 year in the last 3.
  • Must be transferred to an affiliate or branch in the U.S. as an executive or manager.
  • The company must be operating in both countries.

Processing Times

  • Case Preparation: 3 to 6 weeks.
  • USCIS Processing: 4 to 12 months (may vary depending on the subcategory).
  • Premium Processing Option (EB-1A and EB-1B): response in 15 days.

Who can apply?

  • Individuals with recognized extraordinary abilities in their field.
  • Professors or researchers with international experience.
  • High-level executives in multinational companies.

Can I bring my family?

Yes. Your spouse and unmarried children under 21 years old can obtain permanent residency with you.

  • The spouse can work legally.
  • Children can study without restriction.

EB-1 Visa Benefits

  • Some subcategories do not require a job offer (EB-1A).

Frequently Asked Questions

Do I need to have an international award like a Nobel or a Grammy?

It is not mandatory. You can qualify by demonstrating at least 3 of 10 criteria accepted by USCIS, such as publications, leadership, high salary, etc.

EB-1A is for individuals with extraordinary abilities; EB-1B, for outstanding academics; and EB-1C, for multinational company executives.
