What is the EB-3 Visa?

The EB-3 visa is an employment-based immigration category that allows foreign workers to obtain permanent residency (Green Card) in the United States. It is designed for professionals, skilled workers, and other workers, such as non-skilled but necessary personnel.

EB-3 Visa Requirements

The EB-3 has three subcategories:

1. Professionals:

  • Must be a citizen of a country with a commercial treaty with the U.S.
  • Full-time job offer in the U.S.
  • The position must require a university degree.

2. Skilled Workers:

  • At least 2 years of experience or training in the field.
  • Job offer in a position requiring specific skills.
  • Work cannot be temporary or seasonal.

3. Other Workers (unskilled):

  • For jobs requiring less than 2 years of experience.
  • Permanent job offer.
  • Longer waiting time due to high demand.

All subcategories require a formal job offer and the PERM labor certification from the Department of Labor.

Processing Times

  • Labor certification (PERM): 6 to 10 months.
  • I-140 Petition (USCIS): 6 to 12 months.
  • Adjustment of status or consular processing: 8 to 12 additional months.
  • Estimated total time: 18 to 24 months (may vary by country and subcategory).

Who can apply?

  • Professionals with a university bachelor's degree.
  • Technicians and operators with proven experience.
  • U.S. employers who cannot find local labor for certain positions.

Can I bring my family?

Yes. You can include your spouse and unmarried children under 21 years old:

  • Your spouse can work legally with a permit (EAD).
  • Your children can study at any institution.
